Welcome to Bahama Homes (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, platform, and related services (collectively, the “Services”). By creating an account as a Vendor (property owner or manager) or a User (renter), you agree to these Terms in full. If you do not agree, do not use our Services.

1. Definitions

“Vendor” – An individual or entity listing a property or rental accommodation on Bahama Homes for rent.
“User” – An individual or entity seeking to rent or lease a property listed by a Vendor.
“Listing” – Any property or rental accommodation made available on Bahama Homes by a Vendor.
“Platform” – The Bahama Homes website, mobile applications, and any associated tools or services.

2. Eligibility

Be at least 18 years old.
Have the legal authority to enter into binding agreements.
Provide accurate, current, and complete information during registration.
We reserve the right to refuse registration or terminate accounts for any reason, including suspected fraud or policy violations.

3. Account Registration

Vendors and Users must create an account to access most Services.
You are responsible for safeguarding your login credentials and for all activity under your account.
Misuse of another person’s account is strictly prohibited.

4. Platform Role

Bahama Homes acts solely as a facilitator between Vendors and Users. We are not a party to any rental agreement and do not:
– Own, manage, or operate listed properties.
– Guarantee the accuracy of listings or the performance of either party.
Any agreement between Vendor and User is solely between those parties.

5. Listings & Content

For Vendors:
– You are responsible for the accuracy, legality, and completeness of your listings.
– You must disclose all relevant property details, fees, and terms before confirming a rental.
– You may not post false, misleading, or infringing content.
For Users:
– You must review and agree to all terms of a rental before booking.
– You may not use listings for unlawful purposes or sublease without Vendor consent.
Bahama Homes reserves the right to remove or modify any content that violates these Terms.

6. Payments

Payments, deposits, and fees (including cancellation or service fees) are processed as outlined in our Payment Policy.
Vendors may be charged subscription or listing fees for use of certain platform features.
Users may be required to make payments through approved third-party payment providers.
Bahama Homes is not responsible for disputes regarding payments made outside the platform.

6A. Bookings

A booking occurs when a User selects a Listing, agrees to the Vendor’s rental terms, and submits required payment or deposit through the Bahama Homes platform.
Once a booking is confirmed, both Vendor and User are legally bound to honor the agreed terms, subject to the cancellation policy.
Vendors are responsible for ensuring the property is available and in the condition described in the listing at the start of the rental period.
Users are responsible for arriving on time, complying with the property rules, and making any remaining payments as agreed.
Bahama Homes is not a party to any rental agreement and does not guarantee the availability or quality of any property.
Any disputes relating to a booking must first be addressed between the Vendor and the User, with Bahama Homes acting only as a communication facilitator.

7. Cancellation & Refunds

Cancellation terms are determined by the Vendor and stated in the listing.
Refunds, if applicable, are processed according to the Vendor’s policy and applicable laws of The Bahamas.

8. Prohibited Activities

Use the platform for fraudulent, misleading, or illegal purposes.
Harass, abuse, or threaten others.
Circumvent fees or payment processes.
Post harmful code or attempt to disrupt the platform’s operation.

9. Privacy

Your personal information will be collected, used, and stored in accordance with our Privacy Policy.
By using our Services, you consent to this processing.

10. Dispute Resolution

Vendors and Users are encouraged to resolve disputes directly.
Bahama Homes may assist in communication but is not obligated to mediate or resolve disputes.
Any legal claims must be brought in the courts of The Commonwealth of The Bahamas under the laws of The Bahamas.

11. Limitation of Liability

To the maximum extent permitted by law, Bahama Homes:
– Is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our platform.
– Does not guarantee the accuracy or reliability of listings, profiles, or communications between Vendors and Users.

12. Indemnification

You agree to indemnify and hold Bahama Homes harmless from any claims, damages, liabilities, or expenses arising from your use of the platform, violation of these Terms, or infringement of any rights.

13. Changes to Terms

We may update these Terms at any time.
Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your account for any violation of these Terms.
Upon termination, your right to use the Services ceases immediately.
