Welcome to Bahama Homes (“Bahama Homes,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the Bahama Homes website, dashboards, listing tools, rental application tools, booking tools, payment tools, document upload tools, support tools, and related services (collectively, the “Platform”).
By accessing or using the Platform, creating an account, submitting a Listing or application, requesting or confirming a booking, making a payment, uploading documents, or using a Bahama Homes service, you agree to be bound by these Terms. If you do not agree, do not use the Platform or related services.
Additional terms, notices, Listing rules, service terms, payment terms, the Privacy Policy, the Refund Policy, and any written agreement applicable to a particular transaction also form part of your agreement with Bahama Homes.
For purposes of these Terms: Account means a registered User account used to access applicable Platform features. Applicant means a person who submits or prepares a rental application through the Platform. Application Fee means the fee charged for using the Platform’s rental application process and related records or services. Booking means a request or confirmed reservation for a short-term rental Listing. Booking Window means the maximum period before scheduled check-in during which a Guest may submit a booking request for a Listing. Booking Payment means the amount paid through the Platform to confirm a short-term rental reservation, including the accommodation amount, applicable Listing charges, the Guest Service Fee, and any other amount shown before payment, but excluding a Refundable Security Deposit where that deposit is due separately. Custom Quote means a price and service description issued for a Direct Service or another non-standard service request. Direct Service means a service provided or arranged by Bahama Homes, including photography, videography, aerial media, virtual tours, inspections, listing support, document support, marketing support, or another quoted service. Guest means a person who requests, pays for, or occupies a short-term rental. Guest Service Fee means the Bahama Homes platform service fee charged to the Guest for a short-term rental Booking. Host Service Fee means the Bahama Homes platform service fee charged to the Owner/Manager and deducted from the applicable Payout. Lease or Rental Agreement means an agreement between an Owner/Manager and a Tenant, Guest, or other occupant governing use of a property. Listing means a property, rental opportunity, accommodation, or related offering published or prepared for publication on the Platform. Owner/Manager means a person or entity that owns, manages, controls, represents, or is authorized to offer a Listing. For short-term rental Bookings, this term may also be referred to as the Host. Payment Provider means any bank, acquiring institution, card network, payment gateway, financial institution, or payment-service provider used by Bahama Homes to process, settle, refund, hold, release, or disburse funds. Payout means the net amount payable to an Owner/Manager after the Host Service Fee and any approved booking adjustments, refunds, chargebacks, or other authorized deductions. Platform means the Bahama Homes website, dashboards, forms, booking, application, payment, document, communication, support, and related tools. Refundable Security Deposit means an amount required in connection with a rental to protect against property damage, missing items, excessive cleaning, unpaid charges, rule violations, or other permitted deductions. Screening Provider means an authorized third party used to support identity, document, rental-history, employment, background, credit, or other screening where available and permitted. Tenant means a person seeking or occupying a long-term or commercial rental. User means any person or entity that accesses or uses the Platform, including an Owner/Manager, Applicant, Tenant, Guest, payer, or service customer.1. Definitions

Bahama Homes may refuse registration, restrict access, suspend Accounts, remove Listings, decline services, or require additional verification where there is suspected fraud, inaccurate information, misuse, risk, non-compliance, or a policy violation.
An Account may be required to list properties, submit applications, upload documents, make payments, manage Bookings, send messages, or view records. You are responsible for:3. Account registration
You may not use another person’s Account without permission or permit another person to impersonate you. Bahama Homes may require identity checks, document verification, or additional information before allowing certain actions or continued access.
Bahama Homes is a digital rental platform and service provider that helps connect Owners/Managers, Applicants, Tenants, Guests, and other Users. Unless Bahama Homes enters into a separate written agreement stating otherwise, Bahama Homes does not own, operate, lease, rent, inspect, insure, or manage the properties listed by Users. Bahama Homes is not a party to a Lease, Rental Agreement, guest-owner agreement, or property-use agreement between Users, except where Bahama Homes expressly enters into a separate written management, service, or rental-related agreement. Bahama Homes may provide tools for Listings, applications, payments, screening, document handling, communication, Bookings, invoices, receipts, rent records, Refundable Security Deposits, Direct Services, support, refunds, and Payout records. Bahama Homes may also facilitate or administer Booking Payments, Payouts, refunds, and Refundable Security Deposits through approved Payment Providers where the applicable Platform process supports that service. Providing or administering these tools or payment processes does not make Bahama Homes the property owner, landlord, insurer, or property manager and does not transfer an Owner/Manager’s property obligations, legal duties, rental decisions, or responsibility for property condition to Bahama Homes, unless a separate written agreement expressly provides otherwise. Bahama Homes may assist with Platform processes, payment records, communications, policy administration, refund review, deposit review, or dispute documentation. Owners/Managers remain responsible for their Listings, availability, property obligations, rental decisions, lease terms, legal compliance, and treatment of Applicants, Tenants, and Guests unless otherwise agreed in writing.

Owners/Managers are responsible for the accuracy, legality, completeness, and currency of their Listings, including:5. Listings and content
Applicants, Tenants, and Guests must review Listing details, rules, fees, security-deposit requirements, cancellation terms, rental terms, and any applicable Lease or Rental Agreement before applying, booking, paying, or occupying a property.
By uploading or submitting photographs, descriptions, videos, documents, logos, text, Listing information, or other materials, you represent that you have the right to provide them and grant Bahama Homes a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, adapt, publish, distribute, and use them as reasonably necessary to operate, protect, and improve the Platform and provide the related service.
Bahama Homes may use Listing content to promote the applicable Listing and the Platform while the Listing is active or while the related service is being provided. After content is removed or an Account is closed, limited copies may remain in backups, transaction records, dispute records, legal records, or archives for as long as reasonably necessary or required by law.
You retain ownership of your content, subject to the rights granted in these Terms.
Applicants must provide accurate, complete, and truthful information when preparing or submitting rental applications, declarations, references, screening information, and supporting documents. False, incomplete, misleading, outdated, or fraudulent information may result in denial, withdrawal, cancellation, Account restriction, reporting, or other appropriate action. Bahama Homes may provide application tools, screening options, document-upload tools, verification tools, payment tools, and communication tools. Screening services are offered only where available. Their scope, price, consent requirements, and applicable terms will be shown before the service is requested or purchased. Submitting or paying for an application does not guarantee approval, lease execution, occupancy, or continued property availability. Application Fees and Tenant Screening Fees may be required before an application is submitted, reviewed, screened, or made available to an Owner/Manager. These fees are generally non-refundable once the applicable work or processing begins, as identified in the applicable Platform flow or the Refund Policy, except where required by law or in cases of duplicate, unauthorized, or confirmed Platform charges. By submitting an application, you authorize Bahama Homes, the relevant Owner/Manager, authorized representatives, and applicable Screening Providers to review, verify, process, and use application information and supporting documents for legitimate application review, identity verification, fraud prevention, lease preparation, compliance, dispute handling, and rental-record purposes. Where screening is requested, a separate consent or authorization may be required before screening information is obtained or shared. Uploaded documents may include government-issued identification, income records, employment records, rental history, references, proof of address, screening documents, lease-related documents, and other supporting materials. Document handling and retention are explained further in the Privacy Policy.6. Applications, screening, and documents
Owners/Managers are responsible for their conduct, Listings, availability, communications, property obligations, application review, approval decisions, lease or rental terms, Guest or Tenant treatment, and compliance with applicable law. Verification badges, uploaded documents, identity checks, Platform reviews, and screening results may support decision-making but do not guarantee that a person, property, document, payment, or rental arrangement is risk-free.
Payments may be processed through third-party Payment Providers. Bahama Homes does not directly store full card numbers or full online-banking credentials. Payment Providers may retain payment credentials, transaction records, tokens, card type, limited card details, or other information according to their own systems and policies. Users agree to pay all amounts shown at checkout, in a payment request, on an invoice, in a Custom Quote, or in the applicable Platform flow. For short-term rental Bookings, the Bahama Homes platform service fee is shared between the Guest and the Owner/Manager:8. Payments, fees, taxes, and invoices

Short-term rental platform service fees
Both rates include any tax applicable to Bahama Homes’ service. Owners/Managers and other Users remain responsible for taxes arising from their own rental income, property operations, business activity, or other legal obligations unless Bahama Homes expressly states otherwise.
The Guest Service Fee and total amount due will be shown before payment. The Host Service Fee, authorized deductions, and estimated or final Payout will be shown in the applicable booking record, earnings statement, or payout record.
The rates in effect when a Booking is confirmed will continue to apply to that Booking. Bahama Homes may update rates for future Bookings by updating these Terms, a fee schedule, or the amount shown before a future transaction is confirmed.
Fees for applications, screening, Direct Services, and other non-booking services may be presented as a single service price or as separately shown charges. The total and any applicable taxes or additional charges will be shown before payment.
Any future rent-payment or rent-record service fee will be shown before payment and may be charged to the Tenant, Owner/Manager, or included within another Bahama Homes service arrangement.
Failed or incomplete payments
A declined or failed payment does not confirm a Booking, submit a paid application, or complete a service purchase.
For a short-term Booking, the Guest may retry payment while the booking payment window remains open. The payment deadline shown in the booking record applies.
For an application or another service, the User may retry payment while the applicable order, invoice, Custom Quote, or payment request remains open and payable.
A failed payment attempt does not by itself delete or cancel the underlying Booking, application, or service record. The record remains in its applicable payment-pending state unless payment succeeds, the short-term booking payment window expires, the User cancels, the related order or payment request is closed, or Bahama Homes closes the transaction for another permitted reason.
Bahama Homes may restrict or cancel payment access where a transaction has expired, been declined, been cancelled, become unavailable, presents suspected fraud or security concerns, or is otherwise no longer eligible.
Host Payouts
Payment by a Guest does not make the corresponding Payout immediately available.
A Payout ordinarily becomes eligible after the scheduled Guest check-in, once Bahama Homes has received cleared settlement funds and no cancellation, refund review, Guest arrival issue, chargeback concern, compliance review, fraud review, administrative hold, or other valid restriction applies.
Bahama Homes will ordinarily initiate an eligible Payout within two business days after eligibility and cleared settlement, subject to banking hours, public holidays, accurate payout details, and Payment Provider processing.
Payouts require Bahama Homes administrative initiation or approval and are not automatically sent by the Platform.
Bahama Homes may use a later payout date, including after checkout, for new or higher-risk Accounts, unusually high-value Bookings, extended stays, incomplete verification, suspected fraud, disputes, Guest arrival issues, chargeback exposure, compliance concerns, or other reasonable risk-management grounds.
Any Payout hold will remain only as long as reasonably necessary to review or resolve the issue, comply with Payment Provider requirements, or satisfy a legal or regulatory obligation. Bahama Homes may request supporting information and will provide reasonable status information where appropriate and legally permitted.
Once a Payout is marked initiated, it will not be reduced or rewritten because of a later refund or adjustment. If an approved Owner/Manager-attributable amount arises after initiation, Bahama Homes may create a separate Host repayment requirement or future payout offset.
Host repayment and future payout offsets
If an approved refund, chargeback, reversal, booking adjustment, or other amount attributable to the Owner/Manager becomes payable before the Payout is initiated, Bahama Homes may reduce, cancel, or hold the pending Payout.
If the Payout has already been initiated or paid, the Owner/Manager is responsible for repaying the approved Owner/Manager-attributable portion. Bahama Homes may:
- deduct the amount from a pending or future Payout;
- issue a repayment demand;
- place Payouts or Listings on hold;
- record a Host balance adjustment;
- suspend relevant services until the amount is resolved; or
- use another recovery method permitted by the applicable agreement or law.
The Owner/Manager is not responsible for Bahama Homes’ normal Guest Service Fee unless the charge results from the Owner/Manager’s fraud, misconduct, breach, or another expressly stated obligation.
Invoices and transaction records
Bahama Homes may issue invoices, receipts, booking records, earnings statements, payout records, refund records, security-deposit statements, and other transaction records. Users are responsible for reviewing these records and promptly reporting material errors.
All times and deadlines in this section use Bahamas time (America/Nassau, UTC−5 standard time and UTC−4 daylight time). Short-term rental Listings may accept requests up to the Booking Window shown for the Listing. Bahama Homes may apply a maximum advance Booking Window. At launch, the Platform maximum is ordinarily 60 days, although an Owner/Manager may use a shorter Listing-level window. Same-day booking requests must be submitted before 3:00 PM. A same-day request must be accepted by the Owner/Manager before 6:00 PM and fully paid before 8:00 PM. A request submitted, accepted, or paid after the applicable cutoff may be declined, closed, or expired. More than one pending request may exist for overlapping dates. Pending requests do not guarantee availability or confirmation. When an Owner/Manager accepts one request, the accepted dates become blocked and conflicting pending requests may be closed as “Dates no longer available.” The first request validly accepted through the Platform will ordinarily receive priority. Bahama Homes may perform availability checks when a request is submitted, accepted, and paid. A Booking may be declined or closed if the dates have become unavailable because of another accepted Booking, an external calendar block, a property closure, or another valid availability change. A previously closed conflicting request does not automatically reactivate if the accepted Booking later expires or is cancelled. An accepted request is not a confirmed reservation until the full Booking Payment is successfully completed. Where a request is accepted more than 14 days before check-in, payment ordinarily becomes available 14 days before check-in and remains available for 72 hours. Where a request is accepted within 14 days but more than 72 hours before check-in, payment ordinarily becomes available upon acceptance and remains available for 48 hours. Where a request is accepted within 72 hours of check-in, payment ordinarily becomes available upon acceptance and remains available for 24 hours, subject to the applicable check-in and same-day cutoffs. For a same-day accepted request, payment must be completed by 8:00 PM. The payment-open date and payment deadline shown in the booking record will apply. A deadline will not extend beyond an applicable same-day cutoff or other final booking cutoff. If payment is not completed by the deadline, the request may expire, the dates may be released, and an old payment link will no longer be valid. An accepted but unpaid Booking may block the applicable dates while the payment opportunity remains active. Bahama Homes may send email, dashboard, or future text-message reminders when payment becomes available, while a deadline is approaching, after a failed payment attempt, and when a payment opportunity expires. Guests remain responsible for monitoring the booking record and completing payment by the shown deadline even if a reminder is delayed, filtered, or not received. A reservation becomes confirmed only after the required payment has been successfully completed and the Platform records the Booking as confirmed. Guests agree to comply with occupancy limits, check-in and checkout times, property rules, lawful instructions, and the terms shown for the Booking. Owners/Managers remain responsible for property availability, lawful access, property condition, and performance of the property-related obligations connected to the confirmed Booking.9. The short-term provisions in this section apply only where a Listing or Booking has an active Refundable Security Deposit requirement greater than zero. If no Refundable Security Deposit is required, no deposit collection or post-checkout return process applies. The Refundable Security Deposit is separate from the accommodation charge, Guest Service Fee, Host Service Fee, and ordinary Host Payout. Deposit collection method
The collection method and amount shown for the Booking will apply to that reservation.
Under the current launch arrangement, the Refundable Security Deposit is ordinarily due to the Owner/Manager at check-in and is not included in the online Booking Payment. Bahama Homes may introduce electronic collection or authorization holds when supported by an approved Payment Provider.
Where Bahama Homes collects or administers a Refundable Security Deposit, it does so through the applicable Platform and Payment Provider process. The funds remain refundable subject to documented and approved deductions, applicable Payment Provider requirements, these Terms, the Refund Policy, and applicable law.
Booking-specific amount
The security-deposit amount shown on the Listing is the default for future Bookings. The Owner/Manager may reduce, waive, or increase the amount for a particular Booking through the Platform. Any booking-specific adjustment must include a reason, be recorded in the booking history, and be communicated to the Guest.
The original Listing amount and the current booking-specific amount may both be retained in the booking record. A change for one Booking does not alter the Listing default for future Bookings.
An increase made before Booking Payment may apply once the revised amount is shown to the Guest before payment. An increase proposed after payment or confirmation requires the Guest’s express acceptance or Bahama Homes review. A reduction or waiver may be applied later but must still be recorded and communicated.
If the booking-specific amount is waived or reduced to zero, no deposit collection or post-checkout return process applies to that Booking.
Receipt and check-in record
Where a security deposit is due at check-in, the Owner/Manager or Bahama Homes may record it as received, not collected, or not confirmed.
Where received or electronically administered, the record may include the actual amount, collection method, receiving or administering party, date, transaction or authorization reference, and notes.
If a Refundable Security Deposit is disclosed as required and is not paid or confirmed at check-in, the Owner/Manager may refuse check-in or access, subject to the Listing terms and applicable law. The Owner/Manager should record the deposit as not collected and update or report the booking outcome through the Platform.
Failure to complete the check-in record does not remove a Booking with an active required deposit from the post-checkout review process.
Permitted deductions
A Refundable Security Deposit may be applied, in whole or in part, toward documented and permitted charges, including:
- property damage beyond ordinary wear and tear;
- missing items or replacement costs;
- excessive cleaning caused by a breach of property rules;
- unpaid charges attributable to the Guest;
- late departure;
- unauthorized occupancy, smoking, pets, events, or other rule violations; or
- other documented losses permitted by the Listing terms, booking terms, or applicable law.
A deduction request should include a description of the issue and, where reasonably available, photographs, receipts, estimates, invoices, messages, or other supporting records.
Review after checkout
The post-checkout review process applies only where the booking record shows an active required security-deposit amount greater than zero.
The Owner/Manager has up to 48 hours after scheduled checkout to inspect the property and submit a deduction request, damage claim, dispute, or other valid hold.
Where a deposit was required but receipt was not recorded, the review still opens and may be closed as “No deposit received.”
If a received or electronically administered deposit has no open deduction, dispute, administrative hold, damage review, suspected fraud issue, unpaid balance, or other valid restriction when the 48-hour review period ends, it becomes cleared for return or release.
Return or release
After clearance, the responsible party should ordinarily initiate or record the return or release within one business day.
- Cash, wire, or direct-transfer deposits are returned by the party holding the funds and recorded through the applicable Platform workflow.
- Electronically collected deposits are submitted for refund by Bahama Homes or the responsible Payment Provider after administrative initiation.
- Authorization holds are submitted for release or reversal after administrative initiation.
No financial return or release is automatically executed merely because the deposit becomes cleared.
The time required for a returned transfer, electronic refund, or released authorization to appear is controlled by the applicable bank, card issuer, or Payment Provider and may vary.
Bahama Homes may delay or hold a security-deposit workflow where there is an open dispute, administrative hold, pending damage review, suspected fraud, unpaid balance, incomplete review, compliance issue, payment issue, or legal requirement. A hold will remain only as long as reasonably necessary to review or resolve the issue, comply with Payment Provider requirements, or satisfy a legal or regulatory obligation. Bahama Homes may request supporting information and will provide reasonable status information where appropriate and legally permitted.
Security-deposit handling may appear on a receipt, deposit statement, booking record, refund record, or other Platform record. Display of the Refundable Security Deposit does not make it part of the accommodation charge or platform service fee.
Long-term rental deposits and move-in costs
A long-term Listing may show a security deposit, advance rent, first month’s rent, last month’s rent, or other move-in costs required by the Owner/Manager.
Bahama Homes may provide tools to display, calculate, process, transmit, and record these amounts. Use of those tools does not by itself make Bahama Homes the landlord, property manager, deposit administrator, or party responsible for applying or returning the security deposit.
Unless Bahama Homes has entered into a separate written property-management, collection, or deposit-administration agreement, the Owner/Manager remains responsible for:
- setting the amount and lawful purpose of the security deposit;
- determining how and where it is held;
- documenting and supporting any deductions;
- resolving deposit-related claims; and
- returning any balance due to the Tenant.
Where Bahama Homes expressly agrees in writing to collect, hold, administer, apply, or return a long-term security deposit, its responsibilities are limited to the role stated in that agreement, the applicable payment process, the Lease or Rental Agreement, and applicable law.
Processing or recording move-in costs through the Platform does not transfer the Owner/Manager’s landlord obligations to Bahama Homes unless a written agreement expressly provides otherwise.
Bahama Homes may provide tools for Tenants to make rent payments, partial rent payments, lease-related payments, or other property-related payments. Unless Bahama Homes has entered into a separate written management or collection agreement, these tools facilitate payment and records but do not make Bahama Homes the landlord or change the obligations contained in the Lease or Rental Agreement. Tenants are responsible for entering accurate details, including the property, lease reference, rental period, amount, payer information, partial-payment notes, and other requested information. A partial payment, late payment, mislabeled payment, or payment submitted through the Platform does not automatically waive rent obligations, late fees, outstanding balances, default rights, or Owner/Manager remedies. Owners/Managers remain responsible for confirming rent obligations, balances, late fees, lease compliance, and acceptance of partial payments unless Bahama Homes has expressly agreed otherwise in writing. Any applicable rent-payment or rent-record service fee will be shown before payment and may be charged to the Tenant, Owner/Manager, or included within another service arrangement. Bahama Homes may issue rent receipts and payment records. Users must promptly report material errors. Unless expressly agreed in writing, Bahama Homes is not responsible for enforcing rent collection, lease defaults, late fees, eviction rights, or other landlord-tenant remedies.11. Rent payments
Cancellation and refund eligibility depends on the transaction type, payment status, scheduled check-in time, applicable Booking or service terms, Platform records, the Refund Policy, Payment Provider rules, and applicable law. For short-term Bookings, cancellation deadlines are calculated using Bahamas time (America/Nassau, UTC−5 standard time and UTC−4 daylight time). Standard short-term Guest cancellation terms
The standard cancellation terms may be overridden where:
- the Owner/Manager cancels;
- the property is unavailable;
- the Guest cannot lawfully or reasonably access the property;
- the Listing is materially inaccurate;
- a qualifying property, safety, payment, or Platform issue occurs;
- there is a duplicate or unauthorized charge;
- a major emergency event, such as a natural disaster, declared state of emergency, mandatory evacuation, government restriction, or comparable event directly affecting the property, makes the stay impossible, unsafe, unlawful, or unavailable; or
- Bahama Homes approves another exception.
Ordinary bad weather, travel delays, flight changes, personal scheduling conflicts, or a decision not to travel do not automatically qualify for an exception.
At or after check-in
A cancellation, early departure, property complaint, stay interruption, or refund request made at or after scheduled check-in requires manual review.
The standard pre-arrival calculation does not automatically determine the outcome after check-in. Bahama Homes may review unused nights, property access, communications, evidence, Owner/Manager responsibility, Guest conduct, Payout status, and other relevant information.
Refund eligibility, review, and processing
Where a short-term cancellation clearly falls within the standard pre-check-in terms above, the applicable refund eligibility and amount are determined by those terms. Administrative review may be used to verify the cancellation time, payment status, calculation, recipient details, and related transaction records, but it will not remove an otherwise valid refund entitlement.
Manual eligibility review applies to cancellations or refund requests at or after check-in, Owner/Manager cancellations, property availability or access issues, materially inaccurate Listings, claimed emergency or policy exceptions, duplicate or unauthorized charges, disputed facts, and cases where the standard calculation cannot be applied reliably.
In a manual-review situation, Bahama Homes may place a temporary Payout hold, request information, review supporting records, and approve, adjust, partially approve, or decline the request based on the applicable policy and available evidence.
Refunds require Bahama Homes administrative initiation and are not automatically transferred by the Platform. Once a standard-policy or manually reviewed refund is ready for processing, Bahama Homes will ordinarily submit or initiate it within two business days.
Card and electronic-payment refunds commonly take approximately 5 to 10 business days to appear after submission, although the final posting time is controlled by the Payment Provider, financial institution, or card issuer.
Where the payment was made by bank transfer, cash, or another manual method, the responsible party will ordinarily initiate the approved return within the applicable timeframe, subject to accurate recipient details, banking hours, public holidays, and compliance checks.
Owner/Manager responsibility after Payout
If an approved refund or adjustment includes an amount attributable to the Owner/Manager before the Payout is initiated, Bahama Homes may reduce or cancel the pending Payout.
Once a Payout has been initiated or paid, it will remain unchanged. Bahama Homes may instead create a separate Host repayment requirement or future payout offset for the approved Owner/Manager-attributable amount.
Other fees and payments
Application Fees and Tenant Screening Fees are generally non-refundable once the applicable application or screening work has begun, except where required by law or where a duplicate, unauthorized, or confirmed Platform charge occurred.
Direct Services, Custom Quotes, rent payments, and other transaction types may have separate cancellation or refund terms shown in the applicable service quote, invoice, Lease, Rental Agreement, payment request, or Platform notice.
A refund, declined application, cancelled Booking, withdrawn application, or closed Account does not automatically delete transaction, application, communication, dispute, audit, or uploaded-document records. Retention is governed by the Privacy Policy and applicable recordkeeping requirements.
These cancellation and refund terms are subject to applicable law and do not limit any mandatory statutory rights or remedies.

Bahama Homes may offer or arrange Direct Services, including property photography, videography, aerial photo or video, virtual tours, inspections, listing support, lease preparation, document support, marketing support, or another quoted service. A Direct Service may require a Custom Quote, advance payment, full payment, scheduling confirmation, property access, cooperation from the Owner/Manager, and accurate service details. Timing, deliverables, revisions, cancellations, rescheduling, travel requirements, weather delays, property readiness, and usage rights may depend on the specific quote, service description, invoice, checkout notice, or written agreement. Unless otherwise agreed in writing, a Direct Service payment applies only to the service described in the quote, invoice, order, or service confirmation. Bahama Homes may decline, delay, reschedule, or cancel a Direct Service where payment is incomplete, access is unavailable, property conditions are unsuitable, safety risks exist, information is inaccurate, the Listing is not eligible, or performance is not reasonably possible.13. Direct services and custom quotes
Property Marketing Campaigns. A Property Marketing Campaign may include featured placement on Bahama Homes, Listing review or optimization, inclusion in relevant Bahama Homes social-media or digital advertising rotations, location- or rental-type-based promotion, campaign content, and campaign monitoring or performance support. Unless otherwise stated at checkout or in the service confirmation, the standard Marketing Campaign runs for 60 days beginning when Bahama Homes activates the campaign, not on the purchase date.
By purchasing or using a Property Marketing Campaign, the Owner/Manager authorizes Bahama Homes to use the applicable Listing content, including property photos, videos, descriptions, pricing, amenities, location information, and other Listing materials, for reasonable promotion of the property and Bahama Homes through the Platform and third-party advertising or promotional channels. These channels may include social media, digital advertising, search advertising, websites, email, print, video, static advertising, billboards, radio, television, or other promotional media where appropriate. Bahama Homes may adapt, resize, crop, format, combine, caption, or otherwise prepare Listing content for those purposes, subject to the content rights granted in these Terms and applicable law.
Standard Marketing Campaigns may use pooled or rotating advertising that promotes multiple Bahama Homes properties by location, rental type, audience, campaign strategy, or other relevant criteria. Purchase of a Marketing Campaign does not guarantee a dedicated external advertising campaign, a fixed advertising spend for an individual property, a minimum number of impressions, clicks, inquiries, applications, Bookings, rentals, or any other particular result.
Property Spotlight Add-On. Where offered, Spotlight is an enhanced marketing add-on to an eligible Property Marketing Campaign. Unless otherwise stated at checkout or in the service confirmation, Spotlight runs for 30 days from activation and may provide enhanced website placement or priority consideration for selected Bahama Homes advertising creative, including social or digital advertising, video, print, static advertising, billboards, radio, television, or other promotional channels. Spotlight does not guarantee placement on any specific billboard, radio station, television campaign, publication, website, social platform, advertising placement, or media channel. The channels used depend on Bahama Homes’ active media schedule, property location, rental type, available inventory, creative requirements, and campaign strategy.
Marketing Campaigns and Spotlight do not renew automatically. A User must purchase or otherwise agree to a new campaign or renewal period where additional promotion is desired. Bahama Homes may, at its discretion, extend an existing campaign as an administrative adjustment or service accommodation. An extension does not create an automatic right to a refund, credit, additional Spotlight period, or other compensation unless Bahama Homes expressly confirms it.
If a property is rented, booked, sold, withdrawn, suspended, becomes unavailable, or otherwise becomes ineligible for promotion before the end of an active campaign, Bahama Homes may stop or remove the related Featured placement and advertising activity. Once a Marketing Campaign or Spotlight period has been activated, the applicable charge is generally non-refundable and is not prorated merely because the property becomes unavailable before the stated end date. Bahama Homes may, at its discretion, issue a future marketing credit in appropriate circumstances. Any such credit is promotional, is not cash, and is subject to the terms stated when issued. Additional refund rules are stated in the Refund Policy.
Before activation, a cancellation request may be eligible for a refund, subject to any material preparation already completed and any disclosed or documented non-recoverable third-party costs already incurred. If Bahama Homes cancels a paid Marketing Campaign or paid Spotlight service before activation because Bahama Homes cannot provide the service, Bahama Homes may provide a refund, replacement service, rescheduling, or another legally permitted resolution, with any mandatory refund rights preserved.
Photographs, videos, virtual tours, Listing materials, marketing materials, and other deliverables may be used by Bahama Homes for Platform operation, Listing promotion, marketing, portfolio, reporting, or related business purposes unless otherwise agreed in writing.
You may not use the Platform in a way that is unlawful, harmful, misleading, abusive, fraudulent, or inconsistent with these Terms. Prohibited activities include:14. Prohibited activities
Bahama Homes handles personal information in accordance with applicable Bahamian data-protection law and as described in the Privacy Policy. Information may include identification, application data, supporting documents, payment and transaction records, communication records, screening information, Booking details, device information, and other data required for Platform operation, verification, compliance, fraud prevention, payments, applications, Bookings, leases, support, and recordkeeping. Bahama Homes does not directly store full card numbers. Payment information is securely transmitted to and processed by the applicable Payment Provider. Limited payment information, transaction references, tokens, card type, or partial card details may be retained where provided by the Payment Provider. Rental applications, screening records, uploaded supporting documents, and document access are handled according to the Privacy Policy, including applicable collection, use, access, correction, retention, security, and deletion rules. Additional consent or authorization may be requested in the applicable application or screening flow where required. Users should first attempt to resolve disputes directly and in good faith with the other relevant party, such as the Owner/Manager, Applicant, Tenant, Guest, or service provider involved. Bahama Homes may, but is not always required to, assist with communications, records, payment references, refund review, security-deposit review, support tickets, or Platform information. Bahama Homes may make administrative decisions where required to apply a Platform policy, manage a payment or Payout workflow, respond to a chargeback, comply with law, or protect the Platform. These Terms are governed by the laws of The Commonwealth of The Bahamas, without regard to conflict-of-law principles. Subject to any mandatory law, Payment Provider process, or dispute mechanism that applies, the parties agree to submit to the exclusive jurisdiction of the courts of The Commonwealth of The Bahamas for disputes arising from or related to these Terms, the Platform, or Bahama Homes services.16. Dispute resolution
To the maximum extent permitted by applicable law, Bahama Homes is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, use, reputation, business opportunity, rental opportunity, or personal convenience arising from or related to the Platform. Bahama Homes is not responsible for:17. Limitation of liability
Where liability cannot be excluded, Bahama Homes’ total liability for a claim arising from or related to the Platform will not exceed the greater of: (a) the amounts paid directly to Bahama Homes for the specific transaction or service giving rise to the claim; or (b) BSD $100, except where liability cannot lawfully be limited.
Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, or any other liability that cannot lawfully be excluded or limited.
To the extent permitted by law, you agree to indemnify and hold harmless Bahama Homes, its officers, directors, employees, contractors, affiliates, representatives, and service providers from third-party claims, direct damages, losses, liabilities, costs, and reasonable legal fees arising directly from:18. This indemnity does not apply to the extent that a claim or loss is caused by Bahama Homes’ own negligence, wilful misconduct, fraud, or material breach of these Terms.
All Bahama Homes names, logos, branding, design elements, layouts, software, source code, content, forms, templates, workflows, documents, business processes, graphics, and Platform materials are owned by Bahama Homes or its licensors, except for User content or third-party materials. No part of the Platform may be copied, modified, reproduced, distributed, scraped, reverse engineered, sold, leased, sublicensed, or used without prior written permission, except as expressly allowed by these Terms or applicable law. You may not use Bahama Homes branding, logos, trade names, marketing materials, or confusingly similar marks without written permission. If you believe Platform content infringes your copyright, trademark, privacy, publicity, or other rights, contact support@bahama-homes.com with enough information to identify the content and review the claim.19. Intellectual property
The Platform may integrate with or rely on third-party services, including Payment Providers, banks, card networks, hosting providers, analytics providers, advertising tools, Screening Providers, email providers, security tools, communication tools, mapping tools, document tools, and other service providers. Bahama Homes is not responsible for the availability, accuracy, actions, omissions, outages, fees, privacy practices, security practices, terms, or performance of third-party services. Use of a third-party service may be subject to that provider’s own terms, policies, fees, and requirements.20. Third-party services
Users are responsible for complying with all laws, regulations, rules, licences, permits, tax obligations, reporting obligations, payment rules, rental laws, landlord and tenant laws, consumer-protection laws, property laws, safety laws, and other requirements that apply to their use of the Platform. Applicable requirements may include Bahamian data-protection, electronic-communications and transactions, consumer-protection, business-licence, value-added tax, financial-transaction, anti-fraud, proceeds-of-crime, anti-money-laundering, computer-misuse, cybersecurity, accounting, rental, landlord and tenant, contract, court, regulatory, and recordkeeping requirements. Nothing in these Terms limits rights, duties, remedies, disclosures, exemptions, recordkeeping obligations, fraud-prevention actions, legal responsibilities, or compliance obligations imposed by law.21. Compliance with laws
These Terms, together with any policies, notices, Listing terms, service terms, payment terms, privacy terms, refund terms, and written agreements that apply to a specific transaction or service, form the entire agreement between you and Bahama Homes regarding your use of the Platform and supersede prior or inconsistent communications about the same subject matter. If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. Bahama Homes’ failure or delay in enforcing a right, remedy, or provision does not waive it. Any waiver must be in writing and applies only to the specific matter stated. You may not assign or transfer your rights or obligations under these Terms without Bahama Homes’ prior written consent. Bahama Homes may assign, transfer, or delegate its rights or obligations in connection with a merger, acquisition, restructuring, sale of assets, change of control, affiliate arrangement, service-provider arrangement, or business transfer, subject to applicable law. Bahama Homes may provide notices through the Platform, dashboard messages, Account notifications, email, support tickets, published policy updates, or another reasonable method. You are responsible for keeping your contact information current. Headings are provided for convenience and do not limit the meaning of these Terms. You agree that electronic records, notices, confirmations, signatures, communications, and transaction records may be used in connection with the Platform and may satisfy applicable writing, notice, consent, and record requirements, subject to applicable law. Bahama Homes is not responsible for delay, interruption, or failure to perform a Platform or administrative obligation caused by events beyond its reasonable control, including hurricanes, natural disasters, declared emergencies, mandatory evacuations, government restrictions, widespread utility or telecommunications failures, banking or Payment Provider outages, cyber incidents not caused by Bahama Homes’ failure to use reasonable safeguards, labour disruptions, or similar events. This provision does not remove a User’s refund entitlement, payment obligation, duty to return funds, or other mandatory right or obligation where the applicable policy, contract, or law requires it. Bahama Homes may update these Terms periodically. The “Last updated” date indicates the most recent revision. Bahama Homes will provide reasonable advance notice of changes that materially affect Users’ rights or obligations through email, a Platform notice, a dashboard notice, or another appropriate method. The notice will identify when the updated Terms take effect. Changes required by law or needed urgently for security, fraud prevention, Payment Provider compliance, or protection of the Platform may take effect sooner. Notice will be provided as soon as reasonably practicable. Continued use of the Platform after updated Terms take effect constitutes acceptance of the updated Terms. Where a change creates a substantial new financial obligation or materially changes the relationship, Bahama Homes may require separate electronic acceptance. If you do not agree, discontinue use of the Platform and related services before the updated Terms take effect.23. Changes to terms
Bahama Homes may suspend, restrict, or terminate an Account, Listing, application, Booking, payment flow, document access, service request, Payout, or Platform access where there is a violation of these Terms, suspected fraud, security risk, misuse, non-payment, legal risk, harmful conduct, inaccurate information, an unresolved Host repayment, or another reason permitted by law or Platform policy. Upon termination or restriction, access to certain services may cease immediately. Unless prohibited by law, security requirements, or an active investigation, a User may contact Bahama Homes to provide relevant information and request review of a restriction or suspension. Bahama Homes may retain records as described in the Privacy Policy and as required or permitted for legal, tax, accounting, audit, fraud-prevention, security, dispute, payment, chargeback, compliance, or legitimate business-record purposes. Termination does not eliminate payment, repayment, indemnification, dispute, record-retention, intellectual-property, or other obligations that by their nature should continue.24. Termination
