1. Definitions

• Vendor is an individual or entity listing a property on Bahama Homes.
• User is an individual or entity seeking to rent or lease a property listed by a Vendor.
• Listing is any property or accommodation made available on Bahama Homes by a Vendor.
• Platform is the Bahama Homes website, mobile application, and related tools or services.
• Service fees are charges applied for subscription plans, marketing services, or premium features.
• Affiliate partner is a third party offering related services through Bahama Homes (for example cleaning, staging, photography, or maintenance).

2. Eligibility

To use our services, you must:

• Be at least 18 years old
• Have legal authority to enter into binding agreements
• Provide accurate, current, and complete information when registering

If registering on behalf of a company or property management entity, you confirm you have authority to bind that organization. Bahama Homes may refuse registration or suspend accounts for fraud, inaccuracy, or policy violations.

3. Account registration

You must create an account to access most Platform features. You are responsible for maintaining your credentials and all activity under your account. Using another person’s account without permission is prohibited. By registering, you acknowledge and agree to our Privacy Policy.

4. Platform role

Bahama Homes acts as a digital facilitator connecting Vendors and Users. We are not a party to rental or lease agreements and do not own or operate listed properties, except where Bahama Homes manages a property under a separate management agreement.

5. Listings and content

Vendors are responsible for the accuracy, legality, and completeness of Listings, including pricing, fees, rules, availability, and property condition.

Users must review Listing details and terms before applying or booking, and must not provide false information.

By uploading content (photos, descriptions, media), you grant Bahama Homes a non exclusive, royalty free license to use that content for Platform operation and marketing. You retain ownership of your content.

6. Payments

Payments, fees, and transactions may be processed through third party payment providers. Bahama Homes does not store full card or banking details. Prices may be subject to government taxes or duties where required.

7. Booking terms

This section is the one you can deep link from booking and application flows.

• A booking or application becomes effective when the User submits required information and any required payments, and the Vendor confirms according to the Listing terms.
• Vendors must clearly disclose cancellation windows, required deposits, and any non refundable charges in the Listing or lease.
• Users agree to comply with Listing rules, occupancy limits, and applicable laws.

8. Cancellations and refunds

Vendor specific cancellation terms should be displayed in each Listing and or lease. Refund eligibility depends on the Vendor’s policy and the applicable lease or booking terms.

Application fees and tenant screening fees are non refundable, except where required by law or in cases of duplicate or unauthorized charges.

9. Prohibited activities

You agree not to:

• Use the Platform for fraudulent or misleading purposes
• Harass, abuse, or threaten others
• Circumvent Platform fees by completing or soliciting transactions off Platform
• Post spam, malicious code, or disruptive content
• Access or misuse another user’s data

10. Privacy and data

Bahama Homes protects personal data as described in our Privacy Policy. We may collect identification and supporting documents for verification and compliance where applicable.

11. Dispute resolution

Disputes should first be resolved directly between Vendors and Users. These Terms are governed by the laws of The Commonwealth of The Bahamas.

12. Limitation of liability

Bahama Homes is not liable for indirect or consequential damages arising from use of the Platform. Total liability will not exceed the fees paid to Bahama Homes for the transaction concerned, except where liability cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Bahama Homes, its officers, employees, and affiliates from any claim, damage, or expense arising from your use of the Platform, violation of these Terms, or infringement of rights through your content or Listings.

14. Intellectual property

All content, branding, design elements, and software on Bahama Homes are owned by Bahama Homes or its licensors. No part of the Platform may be copied, modified, or reproduced without prior written permission.

15. Third party services

The Platform may integrate with third party services (payment processors, analytics, hosting). Bahama Homes is not responsible for their availability, accuracy, or privacy practices. Use of third party services is subject to their own terms and policies.

16. Changes to terms

We may update these Terms periodically. Significant changes may be communicated through email or Platform notifications. Continued use after updates signifies acceptance.

17. Termination

Bahama Homes may suspend or terminate an account for violation of these Terms. Upon termination, access to services may cease immediately. Bahama Homes may retain certain data for regulatory or audit purposes.
