Welcome to Bahama Homes (“we,” “our,” or “us”).
By accessing or using this website, creating an account, or engaging with any Bahama Homes services, you agree to be bound by these Terms. If you do not agree, please discontinue use of the site and services.
1. Definitions
Vendor – An individual or entity listing a property or rental accommodation on Bahama Homes.
User – An individual or entity seeking to rent or lease a property listed by a Vendor.
Listing – Any property or accommodation made available on Bahama Homes by a Vendor.
Platform – The Bahama Homes website, mobile application, and related tools or services.
Service Fees – Charges applied by Bahama Homes for subscription plans, marketing and advertising services, or premium features.
Affiliate Partner – A third party offering related services (e.g., cleaning, staging, photography, or maintenance) through Bahama Homes.
2. Eligibility
To use our Services, you must:
• Be at least 18 years old;
• Have legal authority to enter into binding agreements; and
• Provide accurate, current, and complete information when registering.
If registering on behalf of a company or property-management entity, you confirm that you have authority to bind that organization.
Bahama Homes may refuse registration or suspend accounts for fraud, inaccuracy, or policy violations.
3. Account Registration
You must create an account to access most platform features. You are responsible for maintaining your credentials and for all activity under your account. By registering, you acknowledge and agree to our Privacy Policy. Using another person’s account without permission is prohibited. Bahama Homes uses reasonable efforts to verify that Vendors are the legitimate owners or managers of listed properties. However, Bahama Homes does not guarantee the accuracy or completeness of any listing.
4. Platform Role
Bahama Homes acts as a digital facilitator connecting Vendors and Users. We are not a party to any rental or lease agreement and do not:
• Own or operate listed properties (except where Bahama Homes manages a property under a separate management contract);
• Guarantee the accuracy, legality, or condition of Listings; or
• Verify or enforce the legality of agreements created between Vendors and Users. Bahama Homes provides optional tools including but not limited to e-lease signing with digital signatures, tenant screening, local market insights, and analytics.
While electronic signatures are legally recognized under the Electronic Communications and Transactions Act (2003), The Bahamas, Bahama Homes is not responsible for the validity or enforceability of individual agreements. Any obligations arising from rental or lease agreements remain strictly between the Vendor and the User, except where Bahama Homes manages a listing under a separate property-management agreement.
5. Listings & Content
For Vendors
• Vendors are fully responsible for the accuracy, legality, and completeness of Listings.
• All property details, fees, and terms must be disclosed before confirming a rental.
• Vendors must ensure listings remain accurate, current, and available. Bahama Homes will send periodic reminders (at least every 30 days) to confirm status and pricing.
• Listings must be updated promptly when properties become rented, unavailable, or change in price or condition.
• Bahama Homes may feature or advertise listings through its marketing and advertising services.
For Users
• Users must review and agree to all terms of a rental before booking or applying.
• Users may not use listings for unlawful purposes, sublet without consent, or provide false information.
By uploading photos or media, Vendors grant Bahama Homes a non-exclusive, royalty-free, worldwide license to use that content for platform operation and marketing. Vendors retain ownership of their media.
6. Payments
• Payments, application fees, and service fees are processed under our Payment and Cancellation Policy.
• All prices are in Bahamian Dollars (BSD) and exclusive of government taxes or duties, which will be added where required by law.
• Vendors may be charged subscription, listing, or advertising fees.
• Users may be charged application or screening fees when submitting rental applications.
• Bahama Homes does not directly process payments and does not collect or store credit- or debit-card information.
All transactions are handled securely by approved third-party payment processors. Bahama Homes may delay or withhold transfers of funds collected directly by Bahama Homes for its own services in cases of suspected fraud, misuse, or chargeback risk. Except where Bahama Homes manages a listing or property under a separate management contract, in which case Bahama Homes may collect rent or deposits directly and apply its own payment and refund policies under that separate property-management agreement. Payments or deposits exchanged directly between Vendors and Users outside of such
agreements remain outside Bahama Homes’ financial control.
6A. Bookings
A booking occurs when a User selects a Listing, agrees to the Vendor’s terms, and submits payment or deposit through the Platform. Once confirmed, both parties are bound by those terms. Bahama Homes is not responsible for reimbursement or damages arising from booking cancellations, property issues, or non-payment.
7. Cancellations & Refunds
• Vendor-specific cancellation terms are displayed in each Listing.
• Refunds for Bahama Homes’ own services or advertising are handled directly by Bahama Homes.
• Refunds or disputes between Vendors and Users (over rent, deposits, or property conditions) must be resolved between those parties.
8. Prohibited Activities
You agree not to:
• Use the Platform for fraudulent or misleading purposes;
• Harass, abuse, or threaten others;
• Circumvent platform fees by completing or soliciting transactions off-platform;
• Post harmful code, spam, or disruptive content;
• Access or misuse another user’s data; or
• Violate housing or tenancy laws of The Commonwealth of The Bahamas.
9. Privacy & Data Protection
Bahama Homes values your privacy and protects your personal data under Bahamian law.
Information We Collect
We collect data you provide (registration, contact, and payment details) and automatic usage data (IP address, browser, analytics).
As part of tenant-screening or application processes, Bahama Homes may collect and securely store copies or scans of government-issued identification and supporting documents. These are used solely for verification and compliance purposes and
protected under our data-security standards.
How We Use Information
We use this data to:
• Create and manage accounts;
• Provide e-lease signing, tenant screening, and analytics services;
• Send communications, updates, and marketing materials (users may opt out at any time using the unsubscribe link in any email);
• Improve functionality and user experience; and
• Comply with legal and regulatory obligations.
Data Sharing
• Bahama Homes does not sell personal information to unaffiliated third parties.
• We may share anonymized or aggregated data for market analysis.
• We share limited personal data with trusted affiliates or processors only to deliver services.
• We may disclose information if required by law, regulation, court order, or valid government request, including to law enforcement or regulatory authorities in The Bahamas.
User Rights
You may request correction or deletion of personal data by contacting us. Certain records may be retained for legal compliance.
Data Security
We use reasonable administrative, physical, and digital safeguards to protect your data, but cannot guarantee absolute security of information transmitted online.
10. Dispute Resolution
Disputes should first be resolved directly between Vendors and Users. For properties managed directly by Bahama Homes, disputes are handled under the applicable management agreement. All claims are governed by the laws of The Commonwealth of The Bahamas, and users outside The Bahamas acknowledge that these Terms are governed exclusively by Bahamian law, without regard to conflict-of-law principles.
11. Limitation of Liability
Bahama Homes is not liable for indirect or consequential damages arising from use of the Platform or for property damage, theft, or loss caused by users. Total liability shall not exceed the fees paid to Bahama Homes for the transaction concerned. This limitation of liability shall not apply to (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under applicable law.”
12. Indemnification
You agree to indemnify and hold harmless Bahama Homes, its officers, employees, and affiliates from any claim, damage, or expense arising from:
• Your use of the Platform;
• Violation of these Terms; or
• Infringement of any rights, including intellectual property, through your content or listings.
13. Intellectual Property
All content, branding, design elements, and software on Bahama Homes are owned by Bahama Homes Ltd. or its licensors.
No part of the Platform may be copied, modified, or reproduced without prior written permission.
14. Third-Party Services
The Platform may integrate with third-party services (payment processors, analytics, hosting, etc.). Bahama Homes is not responsible for their availability, accuracy, or privacy practices. Use of third-party services is subject to their own terms and privacy policies, and Bahama Homes is not liable for their actions or omissions.
15. Changes to Terms
Bahama Homes may update these Terms periodically. Significant changes will be communicated through email or platform notifications. Continued use of the Platform after updates signifies acceptance.
16. Termination
Bahama Homes may suspend or terminate an account for violation of these Terms. Upon termination, access to Services ceases immediately. Bahama Homes may retain certain data for regulatory or audit purposes.
