Bahama Homes – Terms & Conditions

Welcome to Bahama Homes (“we,” “our,” or “us”). By using our website, creating an account, or accessing our services, you agree to these Terms. If you do not agree, discontinue use immediately.
1. Definitions
Vendor – Individual or entity listing a property on Bahama Homes.
User – Individual or entity seeking to rent or lease a property.
Listing – Any property posted on the Platform.
Platform – The Bahama Homes website, mobile application, and related tools.
Service Fees – Fees charged directly by Bahama Homes (application fees, screening fees, subscription plans, advertising services).
Payment Processor – Third-party providers such as CIBC FirstCaribbean, Fygaro, Kanoo, and WooCommerce extensions that handle payment transactions.
2. Eligibility
To use Bahama Homes, you must:
Be at least 18 years old
Have legal capacity to enter agreements
Provide accurate and complete registration information
We may deny or suspend accounts for fraud, abuse, or policy violations.
3. Account Registration
An account is required to access most features. You are responsible for maintaining login security and all actions taken under your account. By registering, you agree to our Privacy Policy.
Bahama Homes may attempt to verify Vendors, but we do not guarantee listing ownership or accuracy.
4. Platform Role
Bahama Homes is a digital facilitator that connects Vendors and Users. We do not:
Own listed properties (unless managed under a separate agreement)
Guarantee property condition, legality, or accuracy
Enforce agreements between Users and Vendors
Tools offered may include e-lease signing, tenant screening, analytics, and communication tools.
Electronic signatures are recognized under the Bahamas Electronic Communications and Transactions Act (2003). Enforceability of agreements remains between Vendor and User.
5. Listings & Content
Vendor Responsibilities
Provide accurate, lawful, updated listing information
Disclose all terms, conditions, and fees
Update listings when rented, inactive, or unavailable
User Responsibilities
Review all listing terms before booking or applying
Submit truthful and complete information
Media License
By uploading content, Vendors grant Bahama Homes a non-exclusive, royalty-free license to use media for platform operation and marketing. Vendors retain full ownership.
6. Payments
Bahama Homes may charge Service Fees including subscription fees, application fees, tenant screening fees, and advertising fees. These fees are collected directly by Bahama Homes.
Bahama Homes does not store credit or debit card information. All transactions are processed securely through third-party Payment Processors, which operate under their own terms and privacy policies.
Bahama Homes is not responsible for:
Payment delays
Bank declines
Processor outages
Verification steps imposed by Payment Processors
Chargebacks or reversals
Rent payments, booking payments, or deposits exchanged between Vendors and Users remain solely between those parties unless Bahama Homes manages a property under a separate management agreement.
Privately exchanged payments between Vendor and User are outside Bahama Homes’ financial control.
6A. Third-Party Payment Gateways
Bahama Homes may integrate with processors including CIBC FirstCaribbean, Fygaro, Kanoo, WooCommerce payment gateways, and others. By making a payment on the Platform, you agree to those providers’ terms.
Payments may redirect you to a secure external page operated by a Payment Processor. Bahama Homes is not responsible for their availability, performance, or data handling.
7. Refunds & Cancellations
Vendor-Controlled Refunds
Refunds, cancellations, and disputes involving:
Rent
Deposits
Booking cancellations
Property condition
Vendor-specific terms
must be resolved directly between Vendor and User. Bahama Homes is not a party to these disputes.
Bahama Homes Service Refunds
Refunds for fees charged directly by Bahama Homes (application fees, screening fees, subscriptions, advertising services) are handled solely under Bahama Homes’ Refund & Cancellations Policy.
No conflicting or implied refunds apply outside of that policy.
8. Tenant Screening & Verification
By submitting an application on Bahama Homes, applicants:
Authorize Bahama Homes to conduct tenant screening, including rental history verification, employment verification, background checks, and credit assessment where available
Confirm all submitted information is truthful and complete
Permit Bahama Homes to share screening results with the Vendor/property owner

9. Privacy & Data Protection
Bahama Homes protects personal data under Bahamian law. View our extended Privacy Policy.

Screening documentation (ID, employment info, references)
Usage analytics
How Data Is Used
To:
Operate user accounts
Deliver screening and verification services
Facilitate property applications
Improve Platform functionality
Comply with legal obligations
Third-Party Sharing
Data may be shared with trusted providers only when required (payment processors, screening services, communication systems).
When redirected to third-party portals, Users are subject to those providers’ privacy policies.
User Rights
Users may request correction or deletion of data. Some records may be retained to meet legal, regulatory, or fraud-prevention obligations.
10. Prohibited Activities
Users may not:
Provide false or misleading information
Harass or threaten others
Circumvent platform fees
Upload malicious or harmful content
Misuse another person’s data
Violate Bahamian tenancy or housing laws
11. Dispute Resolution
Vendor–User disputes (rent, deposits, conditions, cancellations) must be resolved directly between those parties
Payment disputes (bank holds, reversals, chargebacks) must be resolved with the Payment Processor or financial institution
Bahama Homes is not a party to these disputes, except when related to direct Bahama Homes service fees
These Terms are governed exclusively by the laws of The Commonwealth of The Bahamas.
12. Limitation of Liability
Bahama Homes is not liable for:
Indirect, incidental, or consequential damages
Property loss, theft, or damage caused by Users
Financial loss resulting from Payment Processor errors
Bahama Homes’ total liability for its own services is limited to the amount paid directly to Bahama Homes for the transaction in question.
13. Indemnification
Users agree to indemnify and hold Bahama Homes harmless from claims arising from:
Use of the Platform
Violation of these Terms
Content uploaded that infringes rights or laws
14. Intellectual Property
All platform content, branding, design, and software are owned by Bahama Homes Ltd. or its licensors.
No materials may be copied or reproduced without written permission.
15. Third-Party Services
The Platform may integrate with third-party tools (hosting, analytics, payment processors).
Bahama Homes is not responsible for their performance, availability, or privacy practices.
Users are bound by the terms of any third-party service they interact with.
16. Changes to Terms
We may update these Terms at any time. Significant changes will be posted on the Platform or emailed to Users. Continued use indicates acceptance.
17. Termination & Data Retention
Bahama Homes may suspend or terminate accounts for violations of these Terms.
Upon termination, access to services stops immediately.
Certain data may be retained to meet:
Legal requirements
Fraud-prevention obligations
Accounting/audit purposes
This retention aligns with our Privacy Policy.
